Welcome to DeGeorge Plumbing & HVAC. DeGeorge Plumbing & HVAC is a trade name of JHW Plumbing LLC, also doing business as DeGeorge Plumbing. These Terms of Use ("Terms") govern your access to and use of our website at www.degeorgeplumbing.com and our mobile application, DeGeorge Home (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

1. Services Description

DeGeorge Plumbing & HVAC provides plumbing, heating, air conditioning, and related home services in the Phoenix, Arizona metropolitan area. The Platform allows you to learn about our services, request appointments, access your account, view pricing information, and communicate with our team.

2. Eligibility

You must be at least 18 years of age to use the Platform. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

3. Use of the Platform

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Platform in any way that violates any applicable federal, state, or local law or regulation
  • Attempt to gain unauthorized access to any part of the Platform, its servers, or any connected systems
  • Interfere with or disrupt the Platform or the servers and networks connected to it
  • Use any automated system, including bots, scrapers, or data mining tools, to access the Platform
  • Transmit any viruses, malware, or other harmful code
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

4. Account Information

Certain features of the Platform, including the DeGeorge Home mobile app, may require you to create an account or provide personal information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Intellectual Property

All content on the Platform — including text, graphics, logos, images, photographs, videos, and software — is the property of DeGeorge Plumbing & HVAC or its licensors and is protected by United States copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.

6. User-Submitted Content

When you submit information through the Platform — such as contact forms, appointment requests, reviews, or other communications — you grant DeGeorge Plumbing & HVAC a non-exclusive, royalty-free license to use that information for the purpose of providing our services and improving the Platform. You represent that any information you submit is accurate and does not violate the rights of any third party.

7. Appointment Scheduling

The Platform may allow you to request or schedule service appointments. Appointment requests are subject to availability and confirmation by DeGeorge Plumbing & HVAC. Submitting a request does not guarantee a confirmed appointment. We reserve the right to reschedule or cancel appointments as necessary.

8. Pricing and Payment

Pricing information displayed on the Platform is provided for general reference only and is subject to change without notice. Actual service costs may vary based on the scope of work, materials required, and site conditions. Final pricing will be provided before any work begins.

9. Third-Party Links and Services

The Platform may contain links to third-party websites or integrate third-party services (such as payment processing, scheduling, or chat features). These third-party services are governed by their own terms and privacy policies. DeGeorge Plumbing & HVAC is not responsible for the content, privacy practices, or availability of any third-party services.

10. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. DeGeorge Plumbing & HVAC does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

11. Limitation of Liability

To the fullest extent permitted by law, DeGeorge Plumbing & HVAC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform, whether based on warranty, contract, tort, or any other legal theory, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify, defend, and hold harmless DeGeorge Plumbing & HVAC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Platform or your violation of these Terms.

13. Privacy

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Platform, you consent to the practices described in our Privacy Policy.

14. SMS/Text Messaging

By opting in to receive SMS messages from JHW Plumbing LLC dba DeGeorge Plumbing & HVAC, you consent to receive text messages at the phone number you provide. Messages may include:

  • Service-related messages: appointment reminders, service updates, scheduling confirmations, and account notifications
  • Marketing messages: special offers, seasonal promotions, discounts, and other promotional content (only if you separately opt in to marketing messages)

Message frequency may vary. Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan.

You may opt out of SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a one-time confirmation message and will no longer receive SMS messages from us unless you opt in again. You may also reply HELP for assistance or contact us using the information in Section 17 below.

Carrier disclaimer: Wireless carriers are not liable for delayed or undelivered messages. DeGeorge Plumbing & HVAC and its SMS service providers are not responsible for any errors, delays, or failures in message delivery caused by your wireless carrier or network conditions.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Maricopa County, Arizona.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective when posted on this page with an updated effective date. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
